What will be the key points of the new Telework Law that the government is preparing?

The coronavirus has many consequences in different areas, one of them is teleworking, a practice that has gone from 5% of the total number of workers to 30% in the last 6 months, for this reason the Spanish government is preparing regulations on Teleworking, and in this post we will discuss the key points of the new Law, which is in the current draft.

First of all, those who work at least one day a week from home, or 20% of the time in a total of 3 months, may ask the company to assume the proportional part of the electricity or internet expenses.

At the same time, the organization will be able to control the worker's working day, but must provide him/her with computer equipment, since it cannot require him/her to use his/her own devices, nor that work programs be installed on computers or mobile phones for personal use.

People who telework will have the right to digital disconnection, and to have specific working hours to carry out their tasks, outside of which companies will not be able to demand that they are always available.

In order to formalize the teleworking agreement between companies and workers, it will be necessary to notify the INEM office in writing within a period not exceeding 10 days from the date it is formalized. This document must detail the inventory of material delivered to each person and also the useful life, the expenses that the teleworker may have and that the company will pay, a working schedule and availability, and an explicit distribution of the days worked inside and outside the company.

Key points of the new law

This draft also recognizes the right of companies to control the worker's working hours, adopting the measures they deem most appropriate, such as Timenet, an easy and agile system for registering and controlling working hours, which does not require installing any software, just having a device with an internet connection.
