This is how the new Telework Law is evolving

For days now we have been talking about how the new Telework Law that the government is preparing is evolving, which defines remote work as "that remote work that is done at the worker's home or in a place freely chosen by them, during the whole day or part of it, on a non-occasional basis"; and telework as "that work that is carried out through the exclusive or prevalent use of computer, telematic and telecommunication media and systems".

This new Law initially proposes that people who telework will have the right to a “flexible schedule”, that the costs of this work will be borne by the company in its entirety, it is also proposed that remote work be voluntary for the worker and that it will require a remote work agreement, and equal treatment and with the same rights as the rest of the workforce is stipulated.

Regarding working hours, they will need to be reflected in a time record, such as Timenet, that clearly shows the time spent on it, this must necessarily include the time at which the working day begins and ends, also breaks, and/or preparation times, deactivation, etc.

An important point is the right to digital disconnection for people who work remotely, particularly in telework, and appeals to collective bargaining or company agreement with the aim of avoiding the so-called 'smart working' (working at any time and anywhere). However, the text indicates that control of the activity corresponds to the company.

Finally, it should also be noted that the government has agreed to untie telework from work-life balance, in order to prevent it from ending up being used as a way of perpetuating the roles of raising and caring for children on women.
