The first 6 weeks of leave are mandatory for both the mother and the father, and the other 10 can be distributed by each parent as they see fit, and uninterruptedly until the newborn is one year old.
After this first mandatory period of rest, the company where you work must be informed, at least 15 days in advance, of how this leave will be used; in the event that both members of the couple work for the same company, the company may claim that the leaves are not taken simultaneously, as long as there are well-founded, objective and duly motivated reasons in writing.
After these first 6 weeks, there is the possibility of enjoying this maternity and paternity leave part-time, but always having agreed with the company. However, since these subsequent 10 weeks are a right and not an obligation, the worker could renounce it.
Both the mother and the father will be entitled to receive a subsidy of 100% of the regulatory base of their salary during this maternity and/or paternity leave, but without including per diems, restaurant vouchers or transport allowance.
Once the parents return to work, they may be entitled to one hour of absence from work per day, which could also be divided into two fractions, to care for the infant, until it is 9 months old; it is also possible to agree with the company to reduce the working day by half an hour, or accumulate it to be able to use it later in full days.
And another right is to be able to reduce the working day until the child is 12 years old, but in this case it will entail a proportional decrease in salary.
