The Spanish Government approves mandatory registration of working hours

From May it will be mandatory to have a record of your employees' working hours.

The decree approved today includes the obligation for companies to record the working hours of their employees.

It is a new measure that the Spanish Government justifies to avoid abuses by employers in the calculation of hours worked by their employees.

The decree also points to the latest Survey of the Active Population, which details that more than half of the workers hired by companies claim to work more than 40 hours a week without being paid for overtime.

Furthermore, recent studies have shown that having a system for recording working hours helps the company reduce absenteeism.

The Spanish Government decrees the obligation to register for all workers

Daily workday record

The wording of the decree-law includes the obligation to record the specific entry and exit times of each worker. In other words, the register established in companies must specifically include the specific working hours of each employee.

Penalties for not keeping a record of working hours

Not having a time control will result in a serious penalty for the company. This type of penalty translates into fines of between €626 and €6,250.

Records available for four years

The employer will be required to keep records of working hours for at least four years. During this period, the records must be available to workers, unions, labor inspectorates and Social Security.

The regulations come into force in May

From the publication of the decree law, companies are given two months to prepare and implement a record of working hours and thus avoid possible violations in compliance with the regulations.
